the company classify the property as stock...the company agrued that it is the mistake caused by the auditor..but the board rejected its argument....

yes...even though the property had been held for 30 years and producing rental income...

so it is very important for you to classify your property....so don't just ask the forum, because many of them were only "段估"...:smile_38: :smile_38:

but who has the right to classify the property nature? me? my accountant? Auditor? or IRD?

I think if myself to choose I will choose it to be my company asset, and my accountant told me they will do so...

it is determined by the director of the company...but however...if you disposed the property in a short period...IRD can challenge your intention...:smile_38: :smile_38:

if you have other profit to set off..it is no way that IRD would not allowed the expenditure of your flat. but if the place was used as director quarter...your salary tax income would add 10% for quarter value...:smile_38: :smile_38:

So, if i use my company name to hold my property, other than clasifying my property is "asset", what else should I do so that IRD won't consider the "price difference" from selling that property become income of my company? (if I live in that property and not rent out....)

there is not much really...you can classify your property as investment property..they are held for long term for investment purpose (usually yielding rental income)

as long as your property won't sell in short term...if such..ird would ask you for the change of intention (long term to short term) and source of funds etc...
