Tax? Hired by HK company but work in Macau

Im holding Macau permanent citizenship. If I am hired by a Hong Kong company but work at Macau, do I need to pay tax to HK IRD? (I don’t have HK working visa) Mush appreciated!

If you do not have any duties (including meetings) that need to be performed in HK, you most probably do not need to pay HK salaries tax.

You can be charged salaries tax on your income arising in or derived from Hong Kong. If your salary solely depend on your work in Macau, you have no obligation to pay salary tax to HK government.

I will come to Hong Kong for company meeting sometimes around 3-4 times a month.

The thing is I called to ask the taxation department in Macau. The staff asked if my work is at Macau, then why my company doesn’t have a registered account in Macau. I have explained that the company has worked with a local distrbutor, my position is like a middle person of the two parties to act as a consultant for my company. Then he repeated the same thing. And obvioualy he didn’t want to explain much. I need help.

This is a bit paradoxical. If a company is not register in Macau, there is no way for this company to conduct business there.

Yeh, I think the same too. I received another answer today. I went to the Macau gov. department to ask this morning. The staff told me no need to pay Macau tax because I’m hired by hk company and my salary is paid by hk, so where I work is not a problem. As long as I pay tax in hk, it will be fine.

I think it depends on how and where you get your salary. If you get your salary from HK company and base on an account from HK, it is obvious that you are under the employment from HK side and thus you should pay your tax to HK side (the company will also report the corresponding salary expenditure to HKIRD too). I had worked in Macau about 10 years ago and I am a HK citizen. At that time, I knew that some people who worked in Macau may not need to pay the salary tax to Macau if they were working as an consultant (or with similar nature), which did not have actual / physical work done indeed.

You can simply ask your employer about that as he/ she should be required to report your salary expenditure to either HK or Macau.
